Terms and conditions are a legal agreement between:

and

The client: An individual or group of individuals using the services or advice of the placement company.

Internship Makers Terms & Conditions:

The General Terms and Conditions set out by Internship Makers are intended to define the contractual obligations established between the client and Internship Makers and conditions of sale. Please read these Terms & Conditions carefully. All our services, offers and / or reservations are subject to these Terms & Conditions. Performing an internship through Internship Makers, or subscribing to our offers of accommodation or additional services means that the Terms & Conditions below are accepted. Internship Makers retain all rights to reject the application of any person deemed unsuitable and this, at its own discretion. All Internship Makers’ clients are obliged to act in accordance with the rules and regulations established by the contract.

Definitions:

Host company: The company where the internship takes place.

Accommodation Company: The company that offers student accommodation (apartments or host families)

Partners: Companies employed or used by IM for their services (eg host company, accommodation company, taxi company, cleaning service, and any other service providers)

Internship agreement: The contract between the host company and the client (student)

The internship: The internship is not represented by a labor contract but by an internship agreement signed by the host company (not by IM).

The deposit: Corresponds to the payment made to warrant the client’s commitments to IM and allow IM to start internship research among host companies IM is in contact with.

The tutor: Appointed person within the host company who will help and support the client (student).

Acceptance

The client acknowledges having read, understood and accepted the Terms and Conditions.
The data recorded by IM constitute evidence of all transactions made by the client. Data such as invoices, e-mails or communications testify to the client’s commitment and acceptance.

1. Registration and client’s commitments

1.1 Free registration, without any obligation to purchase.

1.2 Upon registration, the client reads and agrees to IM’s Terms & Conditions.

1.3 Clients must provide CVs in Word or PDF format, in English, Spanish or French, depending on the chosen destination.

1.4 Photocopy of valid passport is required.

1.5 The level of English, Spanish or French must be sufficient for the internship abroad depending on the chosen destination.

1.6 The client agrees to provide the necessary information as well as information that may affect the smooth running of the internship. IM reserves the right to refuse application if the client fails to provide information within the acceptable timescale or has a criminal conviction for a serious offence or for one which is incompatible with your chosen destination or anything that in IM’s opinion makes the client unsuitable for the chosen placement.

1.7 To be eligible for an internship in the United States, the client must be over 21.

1.8 The client undertakes not to override the IM recruitment process to obtain an internship directly with the companies of IM’s network. (Companies under contract with IM are not entitled to accept the client if it does not go through the IM legal recruitment process and does not make the payment of fees related to IM services). The client is not allowed to enter into any direct internship agreement with the host company.

2. Internship acceptance conditions

2.1 Once the internship corresponding to the client profile and to its expectations has been found, the client cannot refuse to do the interview with the host company except for valid reasons clearly explained to IM. If applicable, the refusal will result in a search for a new host company and another interview.

2.2 If after the interview, the host company accepts the client, the client cannot refuse to do the internship, except for valid reasons clearly explained to IM. If applicable, the refusal will result in a search for a new hand another interview.

2.3 The deposit cannot be refunded as soon as a first interview has been scheduled with a host company.

2.4 IM can provide up to a maximum of 3 internship offers in case of failure of an interview with a host company. Offers are subject to availability.

2.5 After three refusals by the client, the client will not be placed in an internship program and the deposit will not be refunded.

2.6 When the initial duration of the internship is set, it cannot be changed (or shortened, extended or renewed).

3. Responsibility and behaviour of the client

3.1 It is the responsibility of the client to have a public liability insurance and a medical insurance and/or comprehensive insurance.

3.2 The client is fully responsible for its acts throughout the internship. It is liable for any damage, loss or damage resulting from its acts. The client agrees to indemnify IM, the host company, or any other party that may suffer loss or damage due to the client’s conduct. The client must be insured for any damage or loss that can be caused during the internship.

3.3 The client undertakes to respect the law of the country it will be doing its internship in, and not to harm itself or a third party. If the client does not act in compliance with the facts set out above, it will be deemed fully responsible for the consequences of its acts.

3.4 It is the client’s responsibility to purchase its ticket for travel (and obtain a visa if required), and be available at the start date. If the client deviates from the conditions, no refund will be made.

3.5 It is the client’s responsibility to obtain all necessary documents for traveling abroad.

3.6 The client undertakes to behave respectfully during its internship.

3.7 In the event a problem with the host company, the client must contact IM before ending the internship so that solutions may be found.

3.8 Should the client experience any problems whilst partaking in the internship/ accommodation placement, the client must immediately inform IM in writing by email or letter, with a clear explanation of the problem. In such an event, IM will discuss the problem and ways in which it can be solved with the client. Only what is recorded in a written form either by email or by letter will be taken into account.

3.9 If the client is not satisfied with the internship for a valid and justified reason (see section 7), it must first contact its tutor in order to find a solution. If this approach is not successful, the client needs to contact IM to explain the problem. If IM cannot find a solution, IM agrees to find another internship that meets the expectations, the client’s profile and its field of activity (depending on the availability of Host Companies).

3.10 In case the client decides to terminate the internship by itself, or if the host company decides to terminate the internship of the client due to inappropriate behavior (verbal or physical abusive behavior, racist behavior, drug-taking, alcohol, misconduct, insubordination, behavior deemed unacceptable by the tutor or managers), IM reserves the right not to refund the expenses incurred and not place the client in another host company.

3.11 IM, its staff and its partners cannot be held responsible for any injury, accident, theft, damage, disease, loss, cost or risk that may be incurred during an internship or residence in accommodation provided by IM or a partner of IM.

3.12 The client is responsible for its own safety during the journey and during its stay.

4. Internship Makers commitments and liabilities

4.1 IM acts as an intermediary between the host companies, homeowners, landlords, head tenants, accommodation companies, other service providers (taxi, cleaning service…) and the client.

4.2 IM is not responsible for the services provided by the host companies, homeowners, landlords, head tenants, accommodation companies, its partners or by other service providers (taxi, cleaning service…).

4.3 IM agrees to link the client with host companies according to its expectations, profile, field of activity, skills and according to the requirements and expectations of host companies.

4.4 IM undertakes not to disclose the client’s personal information to commercial institutions or any other person or entity.

4.5 IM can stop all cooperation with the client in the event the profile, expectations or project do not match the expectations and requirements of host companies.

4.6 Once the client has accepted the internship offer and the host company has fixed a start date for the internship, IM agrees to withdraw the internship offer from the market.

4.7 IM agrees to follow the client throughout the internship and ensure its smooth running.

4.8 IM agrees to be available for all relevant information to the client.

4.9 IM agrees to fully refund the client if IM is not able to offer an internship in the client’s field of activity.

4.10 IM cannot be held responsible if the client does not get its visa, or if it does not purchase its travel ticket to ensure the beginning of its internship at the scheduled date.

4.11 IM cannot be held liable for any costs due to flight changes, delays or cancellations. IM does not recommend any airline or insurance provider. It is the responsibility of the client.

4.12 The client hereby acknowledges that IM is not legally responsible for the client during and outside of the internship program.

4.13 IM cannot guarantee any internship placement or accommodation within a specific timeframe. External factors (such as availability of host companies and flights, and visa approval) prevent IM from being able to guarantee a specific date or timeframe. The client agrees that IM will not be held liable for any inconvenience or loss of income due to placement process. The client acknowledges that any expected timeframe for placement is given by IM for information purposes.

4.14 The client accepts, understands and acknowledges that travelling or residing temporarily in a foreign country entails a certain degree of risk and danger, inherently dangerous activities or personal risk, both foreseen and unforeseen, which are fully accepted and assumed by the client. The client discharges IM from liability and this permanently and irrevocably, for any personal injury, physical, psychological, finacial caused by any trip abroad or by residing in a foreign country during the client’s internship. IM or assigns, successors, agents, employees, representatives, host families, host companies, accommodation companies, landlords, head tenants, and other service providers (taxi, cleaning service…) cannot be prosecuted for events beyond their control, such as illness, injury (whether emotional or physical), death, damage, loss, theft.

4.15 The client agrees to waive all the claims against IM and releases IM from its liability (these terms include, assigns, successors, officers, directors, the company itself, employees and agents of the company as well as host companies and any person or entity employed or used by IM) arising from or in connection with any property or physical damages, losses, thefts, accidents, delays, irregularities or other circumstances which the client may suffer from and any circumstances of insuperable force, strikes or government restrictions, war, terrorism, sickness or quarantine or acts or omissions of any agents over which such persons have no direct control, including, without limitation or qualification, airlines, railways, transportation companies, bus, taxi, traffic, restaurants, student residences, apartments, hostels, hotels or host families. The client must understand that he/she is responsible for exercising caution and common sense and taking all measures at all times to avoid injuries and/or death, thefts, losses. The client hereby waives all claims, refund, lawsuits, damages against IM.

4.16 IM takes no responsibility and is not liable for any accidents at any third party’s locations, including but not limited to the premises of the host internship provider and the designated accommodation. It is the client’s responsibility to ensure it purchases personal liability insurance prior to the commencement of its internship. The client is responsible for ensuring that it has purchased full, comprehensive insurance prior to departure abroad, which will cover it for the duration of the internship and which includes, but is not limited to, travel, health, medical and accident insurance. The client must bring all relevant insurance documents when departing abroad.

4.17 The maximum liability of IM is limited to the amount of the service provided to the client.

5. Internship Makers is recruiting

5.1 Internship Makers is likely to hire interns. Spontaneous applications will be considered or not according to the needs of IM. The client selected to work as an intern will not pay any fees or costs relating to the IM internship service. If a deposit has been paid it will be fully refunded. However, the placement of a client at IM does not remove the costs relating to finding accommodation or additional services.

6. The host company

6.1 The host company is the sole decision-maker regarding the choice of applicants for the internship.

6.2 IM cannot guarantee remuneration for the internship by host companies. However the host company must comply with the internship laws applicable in the country where the internship takes place.

6.3 The client must comply with the code of conduct of the host company. (Punctuality, respect for the corporate culture, adherence to the company policies, which may be set out in a staff handbook or verbally)

6.4 The client will be covered by the host company from the beginning of the internship (not by IM).

6.5 If the client accepts the offer made by the host company, the client is under the responsibility of the host company from the beginning of the internship. Any negotiations concerning schedules, bonuses, holidays take place between the client and the host company.

7. Change of host company

7.1 Requesting a change of host company will only be considered under certain conditions:
- Sexual harassment or moral harassment.
- Racial or religious defamation.
- Inability of the host company to keep providing the internship.
- Bankruptcy filing of the host company.
- Breach of security or health measures, which may harm or affect the client.
- Missions given to the client which are not in relation with the internship offered by the host company and the tasks defined during the interview between the client and the host company (see article 3.7 for behavior in this case).
Note: The client must ask all the necessary questions about his/her internship, missions, remuneration, working conditions, working hours, workplace during the interview with the host company.

8. Accommodation general conditions

8.1 Internship Makers does not own any of the accommodations proposed. IM works with partners (owners, head tenants, accommodation companies) for accommodation booking. IM is released from all responsibilities attached to accommodation. Internship Makers only guarantees linking with the owner and / or head tenants of the accommoation and the visit of the accommodation to make sure it exists, that it is well equipped and clean. IM is released its responsibilities regarding the accommodation (in case of loss, theft, non-recovery of the deposit, damages etc..). It is the client’s responsibility to ensure that a contract is made between himself and the owner or head tenant of the accommodation.

8.2 IM does not guarantee the proximity of the host company to the client’s accommodation. IM undertakes to find accommodation for its client as close as possible to its work place, but it is possible that transportation time to work exceeds one hour, especially in peak hours.

8.3 The client is responsible for personal belongings in its accommodation. It must close the door of the apartment and windows for its own safety.

8.4 The client cannot host a guest without informing the owner, head tenant, or accommodation company. It may otherwise be evicted.

8.5 The owner or accommodation company may move the client from its room or accommodation in case of emergency (renovation, disagreements between roommates/flatmates…).

8.6 The client is expected to respect the calm of the accommodation and neighbourhood.

8.7 If the client breaks an item belonging to the owner of the accommodation, the client will be held responsible and asked to reimburse it, or it will be deducted from the deposit. If the amount of the deposit is inferior to the amount of damage, additional expenses will be charged.

8.8 The rent must be paid monthly by the client on the fixed date.

8.9 The payment of the rent will be made by bank transfer or cash.

8.10 The client must pay the deposit and first month’s rent before entering the accommodation.

8.11 The payment of the deposit is mandatory and represents two weeks’ or one month’s rent depending on the owners or general conditions of the accommodation companies IM works with.

8.12 The client must return the accommodation in a clean state (furniture as well as dishes) and during the internship must help to maintain the cleanliness of common rooms (living room, bathroom, kitchen, toilet). In case the cleanliness of the accommodation or the state of the furniture is deemed unacceptable by the owner or the accommodation company, the accommodation company may keep some or all of the deposit depending on the state of the accommodation.

8.13 If the accommodation is not suitable for the client for a valid and justified reason (such as an unhealthy state or security problems) explained to IM, the client shall give notice at a period depending on the country of destination, and conditions of the owner or accommodation company (between ten days and one month). IM is committed to finding alternative accommodation to the client (subject to availability of accommodations).

8.14 If the client decides to move out by itself, it will be responsible for negotiations with the accommodation company or the landlord or the head tenant about the breach of contract and the return of the deposit.

9. Prices

9.1 IM reserves the right to change prices. However, the services are charged on the basis of the rates in effect at the date of the client’s registration.

9.2 The prices are in Euros and include all taxes.

9.3 The prices do not include airfare, insurance, visa costs, excess baggage, airport taxes or the monthly rent of the accommodations. The price may include the taxi transfer from the airport to accommodation and vise versa, if it has been subscribed in the additional services on request.

10. Payment and deposit refund

10.1 IM agrees to refund the 80 euro deposit, if IM is not able to offer an internship in the client’s field of activity.

10.2 After payment of the 80 Euros deposit, the client’s file is sent to the host companies. If the client’s profile matches their expectations, IM organizes an interview with the companies interested in it. If the client is not selected after three interviews organised by IM with companies, no internship placement will be made and the deposit will not be refunded.

10.3 After the first interview organised by IM between the Client and a host company, the 80 euros deposit will not be refunded.

10.4 If the client refuses the proposal of a company which suits its expectations, the deposit will not be refunded, but another internship may be offered. (Subject to availability of internships)

10.5 If the client changes its mind after being accepted by a host company, no refund will be made.

10.6 The cancellation of the application on the ground of change of mind, have found another internship by itself, change of field of study or obtaining credit is not a valid reason to be refunded.

10.7 If IM faces 3 refusals from the client (after having offered host companies or internships matching the client’s expectations), the client will not be placed in internship and the deposit will not be refunded.

11. General terms of payment and reimbursement

11.1 All payments are secure and are made by bank transfer. Checks or cash are not accepted.

11.2 The total payment service should be performed two days after acceptance of the host company. Late payments prior to deadline are subject to a 30 € daily surcharge

11.3 It is the responsibility of the client to ensure that the payment by bank transfer is possible and can be done on time (two days after acceptance of the host company)

11.4 Transfer fees are the responsibility of the client.

11.5 Changes in currency rates are non refundable.

11.6 The cancellation of the application on the ground of change of mind, change of field of study or obtaining credit is not a valid excuse to be refunded.

11.7 If the client changes its mind after being accepted by a host company, no refund will be made.

11.8 If the client decides to stop the internship after its beginning, without informing IM or without valid reasons, the client can not be refunded or placed in another host company.

11.9 Once the final payment has been received, IM send the client the internship agreement signed by the host company.

11.10 Once the student and the company have agreed on the beginning of the internship, service fees are due to IM even if the client decides not to start its internship in the host company for any reason.

11.11 In case of non-payment of services, IM reserves the right to cancel the client’s internship and put back the internship offer on the market. In this case the deposit will not be refunded.

11.12 IM may use the services of a debtor chaser to ensure payment for its services.

11.13 The visa fees, airfare, insurance or the monthly rent of the accommodations are not included in IM packages or services or additional services and must be purchased separately.

11.14 If a problem occurs with IM services, the complaint must be declared in a written form (mail or e-mail) to the administrative department and during the internship period or renting period. Any claims made after the internship period or renting period will not be accepted. In the event of a justified claim, IM reserves the right to make adequate reimbursement.

12. Payment and reimbursement of the INTERNSHIP Package

12.1 The deposit is 80 Euros and will be paid after the personal interview with IM.

12.2 If IM is not able to offer an internship in the field of activity of the client, the 80 Euros deposit will be fully refunded.

12.3 After three internship refusals by the client, the client will not be placed in an internship and the deposit will not be refunded.

12.4 The total payment for IM services should be made two days after acceptance of the host company.

12.5 Once the final payment has been received IM sends the client the internship agreement signed by the host company.

12.6 Once the client and the host company have agreed on the beginning of the internship, service fees are due to IM even if the client decides not to start the internship in the host company.

12.7 IM can provide up to 3 internship offers (subject to availability of internships)

12.8 If IM faces 3 refusals from the client, the client will not be placed in an internship and the deposit will not be refunded.

12.9 After payment of the 80 Euros deposit, the client’s file is sent to the host companies. If the client’s profile matches their expectations, IM organizes an interview with the companies interested in it. If the client is not selected after three interviews organised by IM with companies, no internship placement will be made and the deposit will not be refunded.

13. Payment and reimbursement of the ACCOMMODATION Package

13.1 No deposit is required. The full amount of the service must be paid after the interview with IM.

13.2 If IM is not able to provide accommodation to the client, the amount paid will be fully refunded.

13.3 After entering the accommodation, the client can require alternative accommodation under valid and justified reasons (see Section 8.15).

13.4 Subject to availability, IM can offer a maximum of two accommodation options that meet the expectations of the client (budget). After two refusals, IM will not be able to refund the costs incurred.

13.5 Internship Makers does not own any of the accommodations proposed. IM works with partners (owners, head tenants, accommodation companies) for accommodation booking. IM is released from all responsibilities attached to accommodation. Internship Makers only guarantees linking with the owner and / or head tenants of the accommoation and the visit of the accommodation to make sure it exists, that it is well equipped and clean. IM is released its responsibilities regarding the accommodation (in case of loss, theft, non-recovery of the deposit, damages etc..). It is the client’s responsibility to ensure that a contract is made between himself and the owner or head tenant of the accommodation.

14. Payment and reimbursement of the INTERNSHIP + ACCOMMODATION Package

14.1 The deposit is 80 Euros and will be paid after the personal interview with IM.

14.2 If IM is not able to offer an internship in the field of activity of the client, the 80-euro deposit will be fully refunded.

14.3 If IM faces three internship refusals by the client, the client will not be placed in an internship and the deposit will not be refunded.

14.4 The total payment of the Internship + Accommodation service must be made two days after acceptance of the host company.

14.5 Once the final payment has been received, IM sends the client the internship agreement signed by the host company.

14.6 Once the student and the company have agreed on the beginning of the internship, service charges are due to IM even if the client decides not to start the internship in the host company.

14.7 IM can provide a maximum of 3 internship offers (subject to availability of internships and host companies)

14.8 If IM faces three refusals from the client, the client will not be placed in an internship and the deposit will not be refunded.

14.9 If IM is not able to provide accommodation for the client, the payment of the service will not be committed to.

14.10 Subject to availability, IM can offer a maximum of two accommodation options that meet the expectations of the client (budget). After two refusals, IM will not be able to refund the costs incurred.

14.11 Two days after entering the accommodation, the client may require alternative accommodation for valid and justified reasons (see Section 8.15).

14.12 Internship Makers does not own any of the accommodations proposed. IM works with partners (owners, head tenants, accommodation companies) for accommodation booking. IM is released from all responsibilities attached to accommodation. Internship Makers only guarantees linking with the owner and / or head tenants of the accommoation and the visit of the accommodation to make sure it exists, that it is well equipped and clean. IM is released its responsibilities regarding the accommodation (in case of loss, theft, non-recovery of the deposit, damages etc..). It is the client’s responsibility to ensure that a contract is made between himself and the owner or head tenant of the accommodation.

14.13 Subject to availability, IM can offer a maximum of two accommodation options that meet the expectations of the client. After two refusals, IM will not be able to refund the costs incurred.

14.14 If IM is not able to offer one of the two services (internship or accommodation), the client will only pay for the service provided.

14.15 After payment of the 80 Euros deposit, the client’s file is sent to the host companies. If the client’s profile matches their expectations, IM organizes an interview with the companies interested in it. If the client is not selected after three interviews organised by IM with companies, no internship placement will be made and the deposit will not be refunded.

15. Conditions of the sponsorship offer

15.1 The students (clients) from partner schools receive a 50 € discount on the Internship + Accommodation package.

15.2 The students (clients) from partner schools receive a 20 € discount on the Internship package.

15.3 The students (clients) accompanied by another student (client) receive a 20 € discount for each on the Internship + Accommodation Package.

16. Conditions of offers and promotions

16.1 Offers and promotions cannot be combined.

16.2 The discounts relating to offers and promotions will be specified in the estimate sent to the client.

17. Unavoidable circumstances

17.1 IM and its partners or suppliers are released from their contractual obligations upon the occurrence of a force majeure event, or any act attributable to a third party, or any other circumstances or external cause and / or independent of IM staff, directly or indirectly preventing IM from meeting its contractual obligations. In these circumstances, any delay or failure to perform its obligations may give rise to damages. Cases of force majeure include, without limitation, in addition to the cases recognized by the courts, all natural disasters, acts of war, public order offenses, epidemics, fires, floods and other disasters, acts of any government, all strikes in any form whatsoever (internal, external, …) and any malfunction of the Internet or networks.

18. Confidentiality

18.1 The client agrees not to disclose any information in relation with IM and IM partners to its competitors, schools, institutions or other students.

19. Applicable law and disputes

19.1 These Terms & Conditions are valid from 5th March 2013 and are subject to the laws of Malta. If changes are made to the Terms and Conditions, they will be valid at the time of their publication on the website.
This contract is subject to the laws of Malta. The sole jurisdiction in any dispute is the court of Malta.

These Terms and Conditions represent a contract between the client and Internship Makers.
