Terms and conditions are a legal agreement between:

The client: An individual or group of individuals using the services or advice of the placement company.

Internship Makers Terms & Conditions:

The General Terms and Conditions set out by Internship Makers are intended to define the contractual obligations established between the client and IM (Internship Makers) and conditions of sale. Please read these Terms & Conditions carefully. All our services, offers and / or reservations are subject to these Terms & Conditions. Performing an internship through Internship Makers, or subscribing to its offers of accommodation or additional services means that the Terms & Conditions below are accepted. IM Makers retains all rights to reject the application of any person deemed unsuitable and this, at its own discretion. All Internship Makers’ clients are obliged to act in accordance with the rules and regulations established by the contract.

Definitions:

Host company: The company where the internship takes place.

Accommodation Company: Company that offers to the clients an accommodation (apartments, flat sharing, room sharing, host families)

Partners: Companies employed or used by IM for their services (eg host company, accommodation company, taxi company, cleaning service, internship agency and any other service providers)

Internship agreement: The contract between the host company and the client (student)

The internship: The internship is not represented by a labor contract but by an internship agreement signed by the host company (not by IM) and the client.

The tutor: Appointed person within the host company who will help and support the client (student).

Homeowner / landlord : a natural or legal person who owned a property to accommodate the client.

Head tenants : a natural or legal person whose name is on the contract lease with the landlord.

Articles:

Acceptance

The client acknowledges having read, understood and accepted the Terms and Conditions.
The data recorded by IM constitutes evidence of all transactions made by the client. Data such as invoices, e-mails, Skype conversations, phone calls or communications testify to the client’s commitment and acceptance.

  1. Registration of the client

1.1 Free registration, without any obligation to purchase.

1.2 Upon registration, the client reads and agrees to IM’s Terms & Conditions.

1.3 Clients must provide CVs in editable format (Word, Power Point etc.), in English, Spanish or French, depending on the chosen destination.

1.4 Copy of valid passport, VISA, work permit, resident permit and other documents might be required.

1.5 The level of English, Spanish or French of the client must be sufficient to intern abroad depending on the chosen destination.

1.6 The client agrees to provide the necessary information as well as information that may affect the smooth running of the internship. IM reserves the right to refuse application if :
- the client fails to provide information within the acceptable timescale
- the client  has a criminal conviction for a serious offence or for one which is incompatible with client's chosen destination
- anything that in IM’s opinion makes the client unsuitable for the chosen placement.

 

2 . Internship Makers' (IM) commitments and liabilities

2.1 IM acts as an intermediary between the host companies, internship agencies, homeowners, landlords, head tenants, accommodation companies, other service providers (taxi, cleaning service…) and the client.

2.2 IM agrees to link the client with host companies according to his/her expectations, profile, field of activity, skills and according to the requirements and expectations of host companies.

2.3 IM agrees to do everything necessary to help the client to get his/her internship, such as :
- reviewing, correcting client's CV,
- sending client's application to companies looking for interns,
- providing an advice booklet about how to prepare a professional interview,
- providing a coaching session giving advice to the client to increase his/her chances to get an internship,
- scheduling interview with host company,
provided that the first payment of 80 Euros has been paid by the client.

2.4 IM agrees to send back the internship agreement / internship contract signed by the host company to the client, after receiving the full payment of the package from the client.

2.5 IM agrees to follow the client throughout the internship and ensure its smooth running.

2.6 IM agrees to help the client to resolve problems of communication with the host company that might occur during his/her internship placement, regarding : internship missions, work conditions (cf. host company )

2.7 IM agrees to be available for all relevant information to the client.

2.8 IM cannot guarantee any internship placement or accommodation within a specific timeframe. External factors (such as : interest from host companies, availability of host companies, behavior and speech of the client during the interviews, availability of accommodation, visa approval etc.) prevent IM from being able to guarantee a specific date or timeframe.

2.9 IM cannot guarantee remuneration for the internship by host companies.

2.10 IM can stop all cooperation with the client in the event the profile, expectations or project do not match the expectations and requirements of host companies.

2.11 Once the client has accepted the internship offer and paid for his/her internship package, IM agrees to withdraw the internship offer from the market.

2.12 IM is not responsible for the services provided by the host companies, home owners, landlords, head tenants, accommodation companies, its partners or by other service providers (taxi, cleaning service…).

2.13 IM undertakes not to disclose the client’s personal information to commercial institutions or any other person or entity without the consent of the client.

2.14 IM is not legally responsible for the client during and outside of the internship program.

2.15 IM takes no responsibility and is not liable for any accident, injury, theft, damage, disease, loss, cost or risk that may be incurred during an internship or residence at any third party’s locations, including but not limited to the premises of the host internship provider and the designated accommodation.

2.16 The maximum liability of IM is limited to the amount of the service provided to the client.

  1. Commitment, responsibility and behavior of the client

Internship placement process of the client

3.1 The client understands that by contracting IM, to look for an internship and/or an accommodation or any other services, IM takes time to achieve the work requested by the client. Therefore IM asks for a fee to the client for the achieved work and time spent.

3.2 The client agrees to follow the process step by step as described by IM.

3.3 The clients agrees to pay on time each invoice received from IM for all the services provided.

3.4 The client acknowledges that any expected timeframe for placement is given by IM for information purposes.

3.5 The client agrees to inform IM about his starting and ending dates of IM. If any changes occurs and the host company refuse the new dates, IM will not be considered as responsible and will not issue any refund.

3.6 The client undertakes not to override the IM recruitment process to obtain an internship directly with the host companies of IM’s network. (Host companies under contract with IM are not entitled to accept the client if he/she does not go through the IM legal recruitment process and does not make the payment of fees related to IM services).

3.7 The client cannot contact the host company directly without the consent of IM before having paid the full amount due to IM for its services.

3.8 The client cannot disclose the contact of the host companies to a third person (friend, school, university etc.).

Financial resources of the client

3.9 It is the responsibility of the client to have the financial means to pay the IM services.
The client must be sure he/she has enough financial resources before starting the process with IM.

3.10 It is the responsibility of the client to be aware that traveling abroad is at a certain cost and it is necessary to have the financial resources to live in the country.

3.11 The client agrees that IM will not be held liable for any inconvenience or loss of income due to placement process.

3.12 It is up to the client to negotiate and secure any allowance wanted with the host company for the internship period, during the interview.

Insurance and behavior of the client

3.13 It is the responsibility of the client to have a public liability insurance and a medical insurance and/or comprehensive insurance.

3.14 The client is responsible for its own safety during the journey and during his/her stay.

3.15 The client undertakes to behave respectfully during his/her internship.

3.16 The client is fully responsible for its acts throughout the internship. It is liable for any damage, loss or damage resulting from his/her acts. The client agrees to indemnify IM, the host company, homeowners, landlords, head tenants, accommodation companies, other service providers (taxi, cleaning service…) or any other party that may suffer loss or damage due to the client’s conduct. The client must be insured for any damage or loss that can be caused during the internship.

3.17 The client undertakes to respect the law of the country he/she will be doing its internship in, and not to harm himself/herself or a third party. If the client does not act in compliance with the facts set out above, he/she will be deemed fully responsible for the consequences of his/her acts.

Documents

3.18 It is the client’s responsibility to purchase his/her ticket for travel (and obtain a visa if required), and be available at the start date. If the client deviates from the conditions, no refund will be made.

3.19 It is the client’s responsibility to obtain all necessary documents for traveling abroad. It is the responsibility of the client to take care of his/her VISA. IM cannot be held responsible if the client does not get his/her VISA. There will be no refund of the IM fees if the client does not get his/her VISA.

3.20 Should the client experience any problems whilst partaking in the internship/ accommodation placement, the client must immediately inform IM in writing by email or letter, with a clear explanation of the problem. In such an event, IM will discuss the problem and ways in which it can be solved with the client. Only what is recorded in a written form either by email or by letter will be taken into account.

3.21 If the client is not satisfied with the internship for a valid and justified reason (see section 9), it must first contact his/her tutor from the host company in order to find a solution. If this approach is not successful, the client has to contact IM to explain the problem. IM will contact the host organization. IM will offer to organize a meeting or a call conference between IM, the client and the organization to find appropriate solutions. If IM cannot find a solution, IM agrees to find another internship that meets the client’s profile and his/her field of activity (depending on the availability of Host Companies, length of internship remaining).

3.22 The client must comply with the code of conduct of the host company. (Punctuality, respect for the corporate culture, adherence to the company policies, which may be set out in a staff handbook or verbally)

3.23 In case the client decides to terminate the internship by him/herself, or if the host company decides to terminate the internship of the client due to inappropriate behavior (verbal or physical abusive behavior, racist behavior, drug-taking, alcohol, misconduct, insubordination, behavior deemed unacceptable by the tutor or managers of the host company or professional negligence of his/her work missions, non-compliance with company's rules), IM reserves the right not to refund the expenses incurred and not place the client in another host company.

  1. The host company

4.1 The host company is the sole decision-maker regarding the choice of applicants for the interview and internship.

4.2 The host company shall provide work missions and tasks matching client's profile / studies.

4.3 Depending on the host companies, some of them do NOT provide allowance, accommodation, refund of public transports or lunch. However the host company must comply with the internship laws applicable in the country where the internship takes place.

4.4 The client will be covered by his/her own insurance, the host company is not obliged to provide insurance to the client.

4.5 Any negotiations concerning schedules, bonuses, holidays take place between the client and the host company.

 

  1. Accommodation general conditions

5.1 IM does not own any of the accommodation proposed. IM works with partners (owners, head tenants, accommodation companies) for accommodation booking. IM is released from all responsibilities attached to accommodation. IM only guarantees linking with the owner and / or head tenants of the accommodation and the visit of the accommodation to make sure the premises exist, that the accommodation is equipped for short term renting.

5.2 IM cannot be considered as responsible in case of loss, theft, non-recovery of the deposit, damages etc.

5.3 IM does not guarantee the proximity of the host company to the client’s accommodation. IM undertakes to find accommodation for its client as close as possible to his/her work place, but it is possible that transportation time to work exceeds one hour and a half, especially in peak hours.

5.4 The client is responsible for personal belongings he/she keeps within the accommodation. He/she must close the door of the apartment and windows for its own safety.

5.5 The client cannot host a guest without informing the owner, head tenant, or accommodation company. He/she may otherwise be evicted.

5.6 The owner or accommodation company may move the client from his/her room or accommodation in case of emergency (renovation, disagreements between roommates/flat mates…).

5.7 The client is expected to respect the calm of the accommodation and neighborhood.

5.8 The client must pay the deposit and first month’s rent before entering the accommodation (this close might change, as the deposit depends on owners).

5.9 The rent must be paid monthly by the client on the dates scheduled with the accommodation owner. The payment of the rent will be made by the client by bank transfer or cash (depending on owner). If the client is in arrears regarding the payment of his/her rent, he/she might be evicted from the accommodation without recovering his/her deposit.

5.10 If the client breaks an item belonging to the owner of the accommodation, the client will be held responsible and asked to reimburse it, or it will be deducted from the deposit. If the amount of the deposit is inferior to the amount of damage, additional expenses will be charged to the client.

5.11 The client must return the accommodation in a clean state (furniture as well as dishes) and during his/her stay must help to maintain the cleanliness of common rooms (living room, bathroom, kitchen, toilet). In case the cleanliness of the accommodation or the state of the furniture is deemed unacceptable by the owner or the accommodation company, some part or all of the deposit depending on the state of the accommodation might be kept and/or the client might be evicted from the accommodation.

5.12 If the client decides to move out by itself, he/she will be responsible for negotiations with the accommodation company or the accommodation owner or the head tenant about the breach of contract and the return of the deposit.

 

  1. Prices

6.1 IM reserves the right to change prices. However, the services are charged on the basis of the rates in effect at the date of the client’s registration.

6.2 The prices are in Euros and include all taxes.

6.3 The prices do not include airfare, insurance, visa costs, excess baggage, airport taxes, food, public transport, excursions, activities, taxi transfers or the monthly rent of the accommodation.

  1. Payment of the 80 Euros fees (Deposit for interview)

Process

6.1 Before receiving any payment, IM, sends internship offers to the client (after approving his/her application). IM cannot disclose the details of the host companies before receiving the 80 Euros fees.

6.2 The client sends back to IM a ranking of the host  companies he/she would like to apply to.

6.3 IM corrects client's CV. IM prepares the application of the client. Application of the client is sent by IM to the host companies chosen by the client in his/her ranking.

6.4 IM send  a first invoice of 80 Euros to the client, when a host company shows its interest in client's application and offer to organize a first interview (via Skype or phone).

 

6.5 IM can offer other host companies' internship positions to the client, which are not in his/her ranking. If the client agrees to apply to them (via phone or email), IM sends the application. If a host company wants to organize an interview, IM send the invoice of 80 Euros to the client.

6.6 Some host companies do not require interview with the client to offer them an internship position. In this case, IM send a first invoice of 80 Euros to the client. The client agrees to pay the invoice due. IM sends to the client the information about the company.

6.7 The client agrees to pay the 80 Euros fees after receiving the invoice issued by IM.

6.8 IM sends all the necessary information to the client for him/her to prepare his/her interview with the host company (advice booklet, name of the host company, website of the host company, contact of the host company) after receiving the 80 Euros paid by the client.

6.9 It is the responsibility of the client to ask all the necessary questions about his/her internship, missions, dates of internship, remuneration, working conditions, working hours, workplace during the interview with the host company.

Payment and refund of the deposit

6.10 All payments are secured and have to be made by bank transfer or via Paypal. Bank cheques or cash are not accepted.

6.11 The payment of the 80 Euros fees should be made within two days after receiving the invoice. Late payments prior to deadline are subject to a 10 Euros daily surcharge.

6.12 It is the responsibility of the client to ensure that the payment by bank transfer or Paypal is possible and can be done on time.

6.13 Changes in currency rates are non refundable. Bank transfer fees are the responsibility of the client.

6.14 IM may use the services of a debtor chaser to ensure payment for its services.

6.15 The 80 Euros fees guarantee a minimum of 1 interview between the client and a host company.

6.16 IM can organize up to 3 interviews with host companies for the client, in case of failure from the client to his/her interview.
After paying the 80 Euros, IM guarantees a first interview with a company. The client understands that IM cannot guarantee the organization of other interviews as it all depends on the willing of the companies.

6.17 IM cannot be responsible if no (or no other) host companies is interested in having an interview the client.

6.18 For all the work achieved by IM, the invoice of 80 euros issued by IM is due from the client. The 80 euros are at no condition refundable.

6.19 If the client decides not to attend the scheduled interview with the host company, after receiving the invoice of 80 euros, the 80 euros remain due to IM from the client.

6.20 If the clients decides to quit the process to get an internship without IM, after receiving the invoice of 80 euros, the 80 euros remain due to IM from the client.

6.21 If the client changes his/her mind after being accepted by a host company, no refund will be made  at any condition.

6.22 The cancellation of the application of the client on the ground of : change of mind, waiting for interviews with companies not linked with IM, having found another internship by him/herself, change of dates of internship, change of field of study, not having enough financial resources, not obtaining credit or any kind of grant, or any kind of other reasons, are not valid reasons not to pay the 80 euros neither for the 80 euros to be refund.

6.23 If the client is deemed unprofessional at any stage of the process, IM can evict the client from the process and no refund will be made to the client.

 

  1. Payment of the internship package

7.1 When a host company wants to offer an internship position to the client, it sends to IM a written evidence (email).

7.2  IM sends the invoice to the client, corresponding to the price of the package he/she chose (cf. clause 6.4).

7.3 When a host company wants to offer an internship position to the client, the client has 2 days upon receiving the invoice, to accept or refuse the internship offer.

7.4 The client agrees to make the payment of the invoice to IM, if he/she accepts the internship position, within two days after receiving the invoice.

7.5 If the client fails in responding to IM within 2 days after receiving the invoice as agreed clause 7.2, the payment of the invoice will be due to IM in any case (the client accepting or refusing the internship offer).

7.6 Late payments prior to deadline are subject to a 10 euros daily surcharge.

7.7 In case of non-payment of services, IM reserves the right to cancel the client’s internship and put back the internship offer on the market. In this case the deposit will not be refund. 7.8 The payment of the invoice for the internship package will still be due to IM for all the work achieved.

7.9 After three internship refusals by the client, the client will not be placed at  any other internship position and the deposit will not be refund.

7.10 Once the client accepts the internship position, the client agrees to send his/her internship agreement in English as soon as possible to IM via email.

7.11 Once the final payment has been received by IM, IM sends to the client the internship agreement signed by the host company.

7.12 If the client fail in sending his/her internship agreement via email, IM cannot be responsible in case of cancellation of internship by the company.

7.13 If the client (or his/her school or university or any other third party) send directly his/her internship agreement to the host company (via email or mail), IM cannot be responsible of the non-signature of the internship agreement.

7.14 The clients agrees that some delays in sending back the signed  internship agreement can occur, depending on the host company. IM agrees to do its best to get back the internship agreement signed as soon as possible.

7.15 The cancellation of the internship of the client on the ground of : change of mind, waiting for interviews with companies not linked with IM, having found another internship by him/herself, change of dates of internship, change of field of study, not having enough financial resources, not obtaining credit or any kind of grant, are no valid reasons not to pay the package of internship or to ask a refund of the internship package.

  1. Payment of the accommodation package

8.1 When a client wants to book an accommodation for his/her stay with IM help, he/she needs to contact IM via email to give his exact dates of stay.

8.2 IM will check what accommodation is available for the client. Then, IM will send pictures, descriptions, and prices of the different accommodations which are available to the client.

8.3 The client agrees to pay the IM fees for the accommodation package in order to proceed to the booking of the accommodation.

8.4 If IM does not have any accommodation available for the dates given by the client, IM does its best to offer other options to the client or send him/her contact of accommodation partners.

8.5 The client understand that IM is only an intermediary between owners and clients, so the payment of the rent and the deposit will be paid directly to the owner.

8.6 The client understand IM is not responsible about the refund of the security deposit at the end of the lease but will do its best to find a solution by contacting the owner to know more about the reasons of this non-restitution.

 

  1. Change of host company or refund of the internship package

9.1 In the event a problem with the host company, the client must contact IM before ending the internship so that solutions may be found.

The client did not start his/her internship yet :

9.2 The cancellation of the internship of the client on the ground of, including but not limited to : change of mind, change of interest about the internship offer, waiting for interviews with companies not linked with IM, having found another internship by him/herself, change of dates of internship, change of field of study, not having enough financial resources, not obtaining credit or any kind of grant, scholarship, VISA are no valid reasons not to pay the package of internship or to ask a refund of the internship package.

9.3 The client understands that by contracting IM to look for an internship and/or an accommodation or any other services, IM takes time to achieve the work requested by the client. Therefore IM asks for fees to the client for the work achieved and the time spent.

The client started his/her internship

9.4 Requesting a change of host company will only be considered under certain conditions:
- Sexual harassment or moral harassment.
- Racial or religious defamation.
- Inability of the host company to keep providing the internship.
- Bankruptcy filing of the host company.
- Breach of security or health measures, which may harm or affect the client.
- Missions given to the client which are not in relation with the internship offered by the host company and the tasks defined during the interview between the client and the host company

9.5 In case the client complains about his/her internship, IM agrees to listen to his/her complain and to do its best to arrange the situation.

9.6 The client agrees to contact IM by phone (00356 27 52 20 22) in order to explain the situation.

9.7 IM explains the process to the client in order  to arrange the situation. The client agrees to comply with the following :

- The client meets with his/her tutor from the host company to speak with him/her about the situation to find solutions.
- If the situation remains the same for the client, IM contacts the host company to try to arrange the situation.
- If there is no improvement of the situation, IM tries to do its best to change the client from host companies, however to do so :
- The client needs to still have a minimum of 3 months of internship to do
- The client  needs to have at least a B2 in English, French or Spanish
- IM will send client application to new host companies
- IM cannot assure Host companies will be interested in client's profile
- IM agrees to do its best to try to organize other interviews.
- The client must be available to attend new interviews

10. Internship Makers partners

10.1 Depending on the situation, IM can sometimes work with different partners such as :

10.2 Internship agencies : they help in finding the internship abroad for the client

10.3 Accommodation agencies : they book and manage the accommodation for the client

10.4 Taxi agencies : they take care of the transportation of the client

10.5 Home owners : they own accommodation where the client will stay

10.6 Host families : they offer accommodation and full or half board services for food

10.7 English schools : they provide English lessons to the client

10.8The client might also be put in contact with these partners.

11. Unavoidable circumstances

11.1 IM and its partners or suppliers are released from their contractual obligations upon the occurrence of a force majeure event, or any act attributable to a third party, or any other circumstances or external cause and / or independent of IM staff, directly or indirectly preventing IM from meeting its contractual obligations. In these circumstances, any delay or failure to perform its obligations may give rise to damages. Cases of force majeure include, without limitation, in addition to the cases recognized by the courts, all natural disasters, acts of war, public order offenses, epidemics, fires, floods and other disasters, acts of any government, all strikes in any form whatsoever (internal, external, …) and any malfunction of the Internet or networks.

12. Confidentiality

12.1 The client agrees not to disclose any information in relation with IM and IM partners to its competitors, schools, institutions or other students.

13. Applicable law and disputes

13.1 These Terms & Conditions are valid from 5th March 2013 and are subject to the laws of Malta. If changes are made to the Terms and Conditions, they will be valid at the time of their publication on the website.
This contract is subject to the laws of Malta. The sole jurisdiction in any dispute is the court of Malta.

These Terms and Conditions represent a contract between the client and Internship Makers.
